Employer Status and the Role of the Teaching Hospital
The University will continue to be the employer of clinical academics, however, the Teaching Hospital where the Clinical Academic provides a service will be involved directly in:
The Review of All Vacancies:
- the University will consult the Hospital in this review.
- all changes to be agreed by the Hospital and the University.
The Appointment of Clinical Academics:

the Hospital will be fully consulted about and directly involved in the recruitment and selection process.
- all appointments must be agreed by the University and the hospital as part of the normal selection process.
The Conditions of Appointment for Individual Clinical Academics:
- the University to consult with the Hospital about particular conditions which may be appropriate for individual academics.
- the Hospital to have discretion in the extent to which it provides or funds specific conditions beyond those outlined in this agreement for clinical academics and any conditions it may place on such support.
The Performance Management Of Clinical Academics:
- the University and the Hospital shall conduct performance management of clinical academics by an agreed consultative process in accordance with the following principles:
- the University and the Hospital will agree on a performance management process and coordinate their contribution to this process to ensure maximum effectiveness. - the University and the Hospital will each determine their specific expectations, targets and outcomes required of individual Clinical Academics and performance will be measured against these agreed requirements. - the performance management process will be conducted in accordance with the principles of natural justice and the WA Government Health Industry Medical Officers and Medical Practitioners Agreement 1996.
Disciplinary Action:

the University and the Hospital will agree on a process for the involvement of the Hospital in a disciplinary procedure where there is misconduct or unsatisfactory performance on the part of the clinical academic, in relation to their provision of service at the Hospital.

the University and the Hospital will agree upon a range of measures which may be taken in cases of unsatisfactory performance of a clinical academic. These may include but are not limited to:
- suspension or cancellation of the special clinical loading
- suspension of clinical privilege within the hospital
- In the event that the Hospital is dissatisfied with the performance of a clinical academic and as a last resort, the Hospital may, after consultation with the UWA and the AMA, and the giving of at least one months notice, implement the provisions of clause 4.5 of this agreement.
